TERMS OF SERVICE.

1. Agreement

By using the website, signing up for a membership, booking a session, or entering the gym at 215 Buffalo St., Gilmer, TX 75644, you agree to these terms. If you don't agree, please don't use our services.

2. Memberships & billing

  • Memberships are billed monthly via Square. Your first invoice is sent immediately after signup; access begins when it's paid.
  • Subsequent months auto-renew on the same day each month until you cancel.
  • Personal training packages are billed per the schedule shown at checkout (per session, every two weeks, or weekly, depending on the package).
  • All prices are in USD and exclude any applicable taxes.

3. Cancellation & refunds

  • You can cancel a membership at any time by emailing or calling us. Cancellation stops future billing — the current month is not pro-rated.
  • Personal training and meal-plan purchases are non-refundable once a session has been delivered or a plan has been issued.
  • Unused training sessions expire 90 days after purchase unless otherwise agreed in writing.

4. 24/7 access & door codes

Members receive a personal door code. Do not share it. Sharing access voids your membership without refund and may result in liability for any damage or theft caused by the unauthorized person.

5. Health & safety / Assumption of risk

Exercise carries inherent risks, including injury or, in rare cases, death. By using the gym you represent that you are physically able to exercise and have consulted a physician if appropriate. You assume all risks of injury and release The Body Health & Wellness, its owner, employees, and contractors from liability for any injury, illness, or loss except where caused by gross negligence or willful misconduct.

A separate paper waiver is signed at the gym. That waiver controls in case of any conflict with this section.

6. Member conduct

  • Re-rack your weights and wipe down equipment after use.
  • No harassment, no intoxication, no illegal substances.
  • Report any broken equipment immediately.
  • We may terminate membership for behavior that endangers staff or other members. No refund will be issued in that case.

7. Personal property

We're not responsible for lost, stolen, or damaged personal items. Use the lockers and bring your own lock.

8. Website & accounts

  • You're responsible for keeping your login secure.
  • Don't upload anything illegal, infringing, or harmful to the member file library.
  • We may suspend accounts that abuse the system or violate these terms.

9. Intellectual property

All website content (logos, text, photos, training programs, meal plans) is owned by The Body Health & Wellness and may not be copied or redistributed without permission.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim related to your use of our services is limited to the amount you paid us in the 12 months before the claim.

11. Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts of Upshur County, Texas.

12. Changes

We may update these terms from time to time. Material changes will be posted here with an updated date. Continued use after changes means you accept them.
